The Backlog Reality for Indians
India is the most backlogged country for employment-based green cards. With ~200,000 Indian nationals in the EB queue and only ~2,800 visas allocated to India per year (7% per-country cap), the math is brutal:

Should you buy a house when your green card timeline is uncertain? The answer depends on your situation:
Buy if: You plan to stay 5+ years in the same metro, you can afford it on your H-1B income alone, and your employer is stable. H-1B portability (AC21) lets you change jobs and keep your green card case — you're not trapped at one employer.
Don't buy if: Your employer might not renew your H-1B, you're in a high-cost city where rent makes more financial sense, or you're considering moving back to India in 5–10 years.
AC21 — Job Portability Without Restarting
AC21 (American Competitiveness in the 21st Century Act) allows H-1B holders with an approved I-140 to change employers without restarting their green card case — as long as the new job is in the "same or similar occupational classification."
- I-140 must be approved (not just pending)
- Your green card application must have been pending 180+ days
- New job must be same or similar SOC code
- Priority date is preserved — you don't restart the clock
This is critical: many H-1B holders stay in bad jobs for years out of fear of restarting the green card clock. After I-140 approval + 180 days, you can switch employers freely.
When Your Priority Date Becomes Current
When the Visa Bulletin shows your priority date is current, you can file I-485 (Adjustment of Status). During I-485 pending:
- You get Employment Authorization Document (EAD) — work for ANY employer
- You get Advance Parole (AP) — travel internationally without H-1B visa
- H-1B status becomes less critical — EAD is your work authorization
- File I-485 asap when date becomes current — don't wait
Financial Planning If You Leave the US
Some Indian H-1B holders decide the wait is not worth it and return to India. Financial moves before leaving:
- Roll 401(k) into IRA — keep it in the US, growing tax-deferred
- Close Roth IRA or keep it (withdrawals taxable in India — confirm with a CA)
- Sell US real estate or set up property management
- Open NRO account for US income (rental, dividends) received as non-resident
- File final US tax return as dual-status alien for departure year
- FBAR for the year of departure if you still have US accounts
